PUBLIC PARTICIPATION AND CALL FOR COMMENTS ON THE DRAFT NATIONAL GUIDELINES ON ENVIRONMENTAL DEPOSIT BONDS FOR THE MINING SECTOR; NATIONAL GUIDELINES ON PARTICIPATORY ENVIRONMENTAL MONITORING FOR THE MINING SECTOR AND GUIDELINES FOR DESIGNATION OF AREAS FOR ARTISANAL AND SMALL-SCALE MINING
Environmental Governance Programme (EGP) III is a Global programme whose theme is Responsible Mining for a Green and Just Transition. The objective of EGP is to strengthen the capacities of public institutions to enhance environmental governance and improve sustainable mining practices, while integrating the principles of human rights, mine health and safety, rule of law and gender considerations. The programme is executed through the Project Technical Committee (PTC) to which NEMA is the coordinating entity.
Pursuant to Sections 28 and 147 of Environmental Management and Coordination Act, No. 8 of 1999 and Sections 13 and 221 of the Mining Act, Cap 306, National Environment Management Authority (NEMA) in collaboration with the State Department of Mining (SDM) and in consultation with other relevant agencies has prepared the following Guidelines;
(i) Draft National Guidelines on Environmental Deposit Bonds for the Mining Sector ;
(ii) The draft National Guidelines on Participatory Environmental Monitoring for the Mining Sector; and,
(iii) The Draft Guidelines for Designation of areas for Artisanal and Small-Scale Mining.
Pursuant to Article 10(2) (a) of the Constitution of Kenya that provides for national values and Principles of Governance including public participation, NEMA through this Notice hereby invites interested and affected members of the public and stakeholders to submit their comments, proposals, and recommendations on the draft Guidelines. The draft Guidelines are available on NEMA website www.nema.go.ke and SDM website www.mining.go.ke
Hard copies of the written memoranda may be submitted to the office of the Director General, NEMA house, along Popo Road off Mombasa road, P.O. Box 67839-00200 Nairobi. The soft copies of the written memoranda can also be submitted through email to info@nema.go.ke and ps@mining.go.ke. The submissions should be done by or not later than 25th November 2025.
Comprehensive stakeholder mapping has been undertaken, and physical stakeholders’ public hearings will be on direct invitation only. The schedule for the physical fora is as follows;

18/11/2025 – Embu (Central and Eastern Region)
25/11/2025 – Kisumu (Western Region)
25/11/2025 – Eldoret (Rift Valley Region)
